1. Acceptance of Terms

By accessing or using Nookery ("the App"), provided by SJP Apps ("we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the App. If the App is used for or by a minor, the parent or guardian must agree to these Terms on the minor's behalf.

We grant you a limited, non-exclusive, non-transferable, revocable license to use Nookery for its intended purpose: homeschool planning, scheduling, and student progress tracking. This license is for your personal and family use only.

You retain full ownership of all content you create or upload to Nookery, including lesson plans, schedules, grades, student records, and scanned documents. If you opt in to cloud sync, you grant us a limited license to store and transmit your content solely as necessary to provide the synchronization service.

5. Educational Disclaimer

Nookery is a planning and organizational tool. It is not a curriculum provider, accredited educational institution, or educational authority. You are solely responsible for ensuring your homeschool program meets the requirements of your local jurisdiction. SJP Apps makes no claims regarding the educational outcomes achieved through use of the App.

6. Intellectual Property

Nookery, including its design, code, features, and documentation, is the property of SJP Apps and is protected by intellectual property laws. The SJP Apps and Nookery names, logos, and trademarks may not be used without our prior written consent.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THAT DATA STORED LOCALLY WILL BE PRESERVED IN ALL CIRCUMSTANCES.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SJP APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. THIS INCLUDES, WITHOUT LIMITATION, ANY LOSS OF EDUCATIONAL RECORDS, LESSON PLANS, OR STUDENT DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Data Backup

You are responsible for maintaining backups of your data. While Nookery stores data locally and offers optional cloud sync, we are not responsible for data loss resulting from device failure, app uninstallation, or other circumstances.

10. Indemnification

You agree to indemnify and hold harmless SJP Apps from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to Nookery at any time, with or without cause, with or without notice. Upon termination, your license to use the App ceases immediately. You may also terminate your use at any time by deleting your account (if applicable) and uninstalling the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located within the State of Florida.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last updated" date above. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
