By accessing or using BaofengLink ("the App"), provided by SJP Apps ("we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the App.

We grant you a limited, non-exclusive, non-transferable, revocable license to use BaofengLink for its intended purpose: programming Baofeng and compatible radios via the ESP32 Bluetooth bridge. This license is for your personal use only.

You are solely responsible for ensuring that your use of BaofengLink and any radio programming performed with the App complies with all applicable laws and regulations, including but not limited to FCC regulations (in the United States), licensing requirements, and frequency allocation rules. SJP Apps does not guarantee that any frequency or configuration is legal for use in your jurisdiction. Operating a radio without proper licensing may violate federal law.

5. Hardware Disclaimer

BaofengLink is designed to work with compatible ESP32 bridge hardware and Baofeng radios. We are not responsible for damage to your radio, ESP32 device, or other equipment resulting from use of the App. Incorrect programming may render your radio non-functional. Always verify your configurations before applying them.

6. Intellectual Property

BaofengLink, including its design, code, features, and documentation, is the property of SJP Apps and is protected by intellectual property laws. The SJP Apps and BaofengLink names, logos, and trademarks may not be used without our prior written consent. "Baofeng" is a trademark of Baofeng Electronics Co., Ltd. SJP Apps is not affiliated with or endorsed by Baofeng Electronics.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR THAT RADIO PROGRAMMING WILL BE ACCURATE OR COMPLETE. FREQUENCY DATA AND REPEATER INFORMATION MAY BE OUTDATED OR INCORRECT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SJP APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGE TO RADIO EQUIPMENT, REGULATORY FINES, OR CONSEQUENCES RESULTING FROM IMPROPER RADIO PROGRAMMING. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless SJP Apps from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any radio frequency regulations.

10. Termination

We may suspend or terminate your access to BaofengLink at any time, with or without cause, with or without notice. Upon termination, your license to use the App ceases immediately. You may also terminate your use at any time by uninstalling the App.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located within the State of Florida.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be reflected in the updated Terms available on our website with a revised "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
