1. Acceptance of Terms
By accessing or using 360 Streaming ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legal agreement between you and SJP Apps ("we," "our," or "us").
2. Description of Service
360 Streaming is a web-based platform that enables multi-angle 360-degree live streaming. The Service allows broadcasters to stream live video content and viewers to watch those streams.
3. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.
4. Broadcaster Accounts
Broadcasters must create an account to use the streaming features. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
5. Content Policy
Broadcasters are solely responsible for the content they stream. You agree not to stream or broadcast content that:
- Is illegal or promotes illegal activities
- Infringes on any third party's copyright, trademark, patent, trade secret, or other intellectual property rights
- Contains or promotes violence, threats, harassment, hate speech, or discrimination
- Contains sexually explicit or pornographic material
- Contains malware, viruses, or other harmful code
- Impersonates another person or entity
- Violates the privacy rights of others, including streaming individuals without their consent where required by law
- Contains false, misleading, or deceptive information
- Violates any applicable local, state, national, or international law or regulation
We reserve the right to remove content and terminate accounts that violate this Content Policy, at our sole discretion and without prior notice.
6. Copyright and Intellectual Property
You must have all necessary rights, licenses, and permissions to stream any content through the Service. This includes, but is not limited to:
- Music and audio content
- Video content and visual media
- Performances and live events
- Any other copyrighted material
If you do not own or have proper authorization to stream content, do not stream it. We will respond to valid notices of copyright infringement and may terminate accounts of repeat infringers.
7. Restrictions
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the Service
- Reverse engineer, decompile, or disassemble the Service, except as permitted by applicable law
- Attempt to gain unauthorized access to the Service or its related systems
- Use the Service to transmit spam, malware, or other harmful content
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated means to access the Service without our permission
- Resell or redistribute access to the Service without authorization
- Record, re-stream, or redistribute streams from the Service without the broadcaster's explicit permission
8. Intellectual Property
The Service, including its design, graphics, code, and branding, is owned by SJP Apps and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.
9. Streaming Liability
You acknowledge and agree that:
- We are a platform provider and do not control or endorse the content of any stream
- We are not responsible for the content, accuracy, or legality of any broadcast
- Live streams are transmitted in real time and are not pre-screened or moderated by us
- We do not record or archive streams; video data is not stored by the platform
- We are not liable for any technical issues, interruptions, or quality degradation during streams
- Broadcasters are solely responsible for compliance with all applicable laws regarding their streaming activities
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT ANY SPECIFIC STREAMING QUALITY, LATENCY, OR UPTIME.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SJP APPS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM STREAM CONTENT, STREAM INTERRUPTIONS, DATA LOSS, OR UNAUTHORIZED ACCESS TO YOUR ACCOUNT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless SJP Apps and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.
13. Termination
We may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms or the Content Policy. Upon termination, your right to use the Service will immediately cease. We may also remove any content associated with your account.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SJP Apps operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last updated" date. For registered users, we will make reasonable efforts to notify you of material changes. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
